You May Be Under More Than One Association

The feature of large master-planned development that catches owners hardest. A property can sit within a village or sub-association that has its own board and documents, which in turn sits under a master association with its own.

Each layer may have architectural standards, and each may have a view on what a repair or a rebuild is permitted to look like. After a fire that means more than one set of documents to obtain and possibly more than one approval to secure.

How Do I Find out How Many Apply to Me?

Ask the managing agent for every governing document that binds the parcel, in writing, and be explicit that you want the master documents as well as the immediate ones. Owners routinely receive only one layer because that is what they asked for, and then discover the other later.

Approval and Permit Are Different Things

A design approved by the building department is not thereby approved by the association, and a committee approval does not produce a permit. They are separate bodies applying separate criteria on separate timetables.

For a rebuild that means two processes running in sequence more often than in parallel, and it is the single most underestimated line in a northwest programme. The statutory background is on our page covering who decides the rebuild.

Does That Make My Property Harder to Sell?

It makes it slower to develop, which affects buyers pricing a rebuild rather than the property itself. Buyers who work this part of the valley build the timeline in. Buyers who do not will discover it, and their number will move when they do.

The Construction Is Newer, Which Cuts Against You

Most of this housing dates from the 1990s onward, which means engineered roof trusses and floor systems, slab-on-grade foundations and stucco over frame.

Engineered assemblies do not repair in sections. Once heat has compromised the connections they come out whole, so a fire reaching the roof structure here more often produces a replacement than the same fire in older central stock. Stucco is a skin over framing and carries nothing, so a standing stucco elevation is not a shell.

And heat damage to a slab is invisible, which makes it the largest unknown on most files here and the thing buyers discount hardest for.

The Numbers Behind a Northwest File

Chapter 116 governs associations statewide. NRS 116.31135 requires prompt repair of insured portions with only 3 exceptions, one being an 80 per cent vote of owners not to rebuild, and NRS 116.31138 allows those provisions to be waived only for wholly nonresidential communities.

On the transaction side, Clark County transfer tax runs at $2.55 per $500 of value, made up of the $1.95 state rate and a $0.60 county addition. Nevada assesses at 35 per cent of taxable value, with abatement capped at 3 per cent for a primary residence and 8 per cent otherwise.
